Welcome to the Mayfield Furniture Online Terms and Conditions. Please read them through carefully before using the website and/or placing your order. They do not affect your statutory rights. Your continued use of this website constitutes your agreement to be bound by these terms and conditions which shall also govern all transactions on the website to the exclusion of any other terms and conditions.

10 GENERAL
1.1
These Terms and Conditions (“Terms”) apply to goods supplied by Mayfield Furniture (“Mayfield Furniture ”, “we”, or “us”) of 24-32 Nottingham Road, Somercotes, Alfreton, Derbyshire, DE55 4JJ and ordered from Mayfield Furniture’s website at www.mayfieldfurniture.co.uk (the “Website”).
1.2
These Terms should be read carefully by you before you place an order for goods from Mayfield Furniture. You will be asked to accept these Terms before placing your order. If you do not accept these Terms you should not place an order.
1.3
No contract exists between you and Mayfield Furniture for the sale of any goods until Mayfield Furniture has received and accepted your order and sends you confirmation by writing or email to the address or email you have given. Mayfield Furniture shall not be under any obligation to accept your order but once it has done so by sending you confirmation by writing or email there is a binding legal contract between you and Mayfield Furniture.
1.4
We reserve the right to decline all or part of any order for whatsoever reason and should this occur we will contact you with these details.
1.5
You must be eighteen (18) years of age or older to order from the Website and by accepting these Terms you are confirming to us that you no less than eighteen years of age.
1.6
Any contract between you and Mayfield Furniture is subject to your right of cancellation if you are a consumer (see 5.1 below).
1.7
Mayfield Furniture may change these Terms without notice to you in relation to future sales.
2.1
All goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, Mayfield Furniture will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
2.2
The description, specification and price of the goods you order will be as shown on the Website at the time you place your order.
2.3
Subject to 2.4 below, the price of the goods will be the price quoted on the Website at the date the order is received. All prices are quoted in UK pounds sterling and will, unless specified to the contrary on the Website, include packaging and delivery charges.
2.4
Every effort will be made to ensure that prices shown on the Website are accurate at the time you place your order. If an error is found prior to despatch of the goods, Mayfield Furniture will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, Mayfield Furniture will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
2.5
The price of the goods shown on the Website is inclusive of VAT at the current rate of 17.5%.
3.1
Payment for the goods and delivery charges can be made by any credit card that is shown as acceptable on the Website at the time you place your order (presently being Mastercard, VISA, VISA Electron, Maestro and Solo).
3.2
All deliveries are subject to prior authorisation of your payment before dispatch.
4.1
If "Home Delivery" is selected, The goods you order will be delivered to the address you give when you place your order, subject to confirmation of your order by Mayfield Furniture and arrival of order.
4.2
If "Collect form Store" is selected, The goods you order will be available for collection from our store or warehouse, subject to confirmation of your order by Mayfield Furniture and arrival of order. Proof of ID will be required prior to the orders release.
4.3
If delivery cannot be made to your address, Mayfield Furniture will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.
4.4
If there is no one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.
There may be a re-delivery charge.
4.5
Every effort will be made to deliver your order within the time period specified upon order. If Mayfield Furniture is unable to deliver your order within the time period specified, Mayfield Furniture will inform you as soon as possible. Mayfield Furniture will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.
4.6
You will become the owner of the goods you ordered and responsible for risk of loss or damage to them once they have been delivered to you.
4.7
All natural and synthetic colours and finishes can only be supplied on the understanding that there is always a possibility of variation.
Leather and wood products will by their nature be subject to grain variations. Whilst every reasonable effort will be made to ensure colour matches, fabrics and leather may vary due to dye lot variations. Mayfield Furniture will not be responsible for colour variations in the event that matching items are not purchased together.
4.8
Before placing an order, please check that the items of furniture you wish to order will fit through any passages, stairways, landings and doorways on the way to the chosen room. Where items are returned as unwanted, we reserve the right to make a charge of £60 to cover the return shipping cost.
4.9
Upon submitting your order, you will be requested to confirm that you have checked access thoroughly, Mayfield Furniture shall not be responsible for thrid party's incorrect measuring.
4.10
For any queries regarding item sizes including pre-assembled form (wardrobes, dining tables) please feel free to contact us by hand or post, telephone or email, at the address, telephone number or email address shown at paragraph 9 below.
5.1
If you are a consumer, you have the right to cancel the contract at any time up to the end of seven working days after you receive the goods. A working day is any day other than weekends and bank or other public holidays in the United Kingdom.
5.2
To exercise your right of cancellation, you must give written notice to Mayfield Furniture by hand or post, telephone or email, at the address, telephone number or email address shown at paragraph 9 below, giving details of the goods ordered and (where appropriate) their delivery.
5.3
If you exercise your right of cancellation after the goods have been delivered to you, you must return the goods to Mayfield Furniture at your own cost, in unused and otherwise re-saleable condition. The goods must be returned to the address shown below by registered post. The goods must be adequately sealed in the original packaging (where applicable) and you must take reasonable care to ensure the goods are not damaged whilst in your possession or in transit.
5.4
Once you have notified Mayfield Furniture that you are cancelling the contract, Mayfield Furniture will refund or re-credit you within 30 days of receiving notice of such cancellation for any sum that has been paid by you or debited from your credit card for the goods.
5.5
If you do not return the goods as required after exercising your right of cancellation, Mayfield Furniture may charge you for the direct costs of recovering the goods.
5.6
We regret that we cannot accept returns of mattresses or pillows that have been unsealed and removed from the original packaging; your right to cancel will have ended for reasons of health and hygiene, as the product will be deemed to have be used and therefore they are exempt from the statutory seven day cooling off period.
5.7
To any items that have been "Made to Order" specifically for you i.e Sofas. In this case we reserve the right to charge a cancellation fee of 30% of the purchase price.
5.8
Mayfield Furniture will not accept the return of any item which has undergone any assembly by the purchaser.
All items returned to Mayfield Furniture must be in there original packaging and returned in same conditions as they were delivered.
6.1
Mayfield Furniture shall not be responsible for any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party.
6.2
Subject to paragraph 6.1, if the goods supplied to you are in any way defective or you have any other complaint about the goods, you should contact Mayfield Furniture by phone or notify Mayfield Furniture by post, fax or email in accordance with the contact details at paragraph 9 below.
6.3
Mayfield Furniture will not be liable for losses relating to any business (such as lost profits or consequential loss) which arise from any failure by Mayfield Furniture to supply the goods in accordance with the contract.
6.4
Mayfield Furniture shall not be held responsible for any delay or failure to comply with its obligations under these terms and conditions if the delay or failure arises from any cause which is beyond Mayfield Furniture’s reasonable control. This condition does not affect your statutory rights.
7.1
Mayfield Furniture will take all reasonable precautions to keep the details of your order and payment secure but unless Mayfield Furniture is negligent Mayfield Furniture will not be liable for unauthorised access to information supplied by you.
7.2
Mayfield Furniture will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise (Newsletter). You can correct any information about yourself by logging into your account.
7.3
You are responsible for maintaining the confidentiality of your account number and password and also for all activities which take place under your account.
7.4
You agree to immediately notify us of any unauthorised use of your password or account or any other breach of security. In no event will Mayfield Furniture be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your account number and/or password. You may not use another person's account at any time, without the express permission of the account holder.
8.1
Mayfield Furniture may use technology to track the patterns of behaviour of visitors to the Website and ‘personalise’ your viewing experience. This can include using a ‘cookie’, which would be stored on your browser. The information collected in this way can be used to identify you unless you modify your browser settings. You can usually modify your browser to prevent this happening. However, the Website may not work as well as it might if you switch off cookies. 10.1
These Terms are not intended to and shall not create any rights, entitlements, claims or benefits enforceable by any person other than the person who is party to a contract with Mayfield Furniture for the supply of goods.
10.2
These Terms and the supply of the goods by Mayfield Furniture will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.
